Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to apply to or join the Program. By purchasing, you confirm that the information you give us is accurate and complete.

What the Program includes

The Program is a trading education and mentorship program. It includes:

• access to our recorded lesson library;
• a personal roadmap channel where your mentor sends your next lessons;
• live group calls held after the New York trading session on market days;
• 1-on-1 calls with a mentor;
• review of and feedback on your trading journal; and
• access to the private PEAK Discord community.

We may update, add, reorganize, or remove lessons, change call schedules or formats, and change which mentors run sessions. Live calls may be moved or cancelled for holidays, market closures, or circumstances outside our control. These changes don't entitle you to a refund.

Education only, not financial advice

Everything we provide is for educational purposes only. Nothing in the Program is financial, investment, legal, or tax advice, and nothing is a recommendation to buy or sell any security, futures contract, currency, cryptocurrency, or other financial instrument. Any trades, charts, or examples are shown to teach concepts.

We don't provide trade signals, manage money, or trade on your behalf. You alone decide whether, what, and how to trade, and you're solely responsible for those decisions and their results. PEAK TRADING LLC is not a registered investment adviser, broker-dealer, or commodity trading advisor.

No guarantee of results

We do not promise or guarantee that you'll become profitable, earn any amount of money, pass a funded-account evaluation, or reach any particular outcome. Your results depend on factors we don't control, including your effort, consistency, discipline, risk management, capital, and market conditions.

Any examples, trades, or results shared by PEAK or by other members are not typical and don't mean you'll achieve similar results.

Trading risk

Trading involves substantial risk, and you can lose some or all of the money you trade with. With leveraged products such as futures and forex, losses can exceed your initial deposit. By joining, you confirm that you understand these risks, that you'll only trade with money you can afford to lose, and that PEAK is not responsible for any trading losses.

Payments

The price and payment options are confirmed with you before you buy. You can pay in full or, where offered, on a payment plan.

Payment plans. If you choose a payment plan, you authorize us, through our payment processor Stripe, to charge your payment method for each installment on schedule until the full price is paid. You are responsible for the full purchase price, not just the payments made so far. Leaving the Program, not using it, or being removed under these Terms does not cancel or reduce your remaining payments.

Failed payments. If an installment fails, we may pause your access until your account is up to date.

Financing. If you pay through a financing provider such as Klarna, your financing agreement is between you and that provider and is governed by its terms. Our Refund Policy still applies to your purchase.

Taxes. You're responsible for any taxes that apply to your purchase, unless we collect them at checkout.

All sales are final

All purchases are final and non-refundable, as described in our Refund Policy, which is part of these Terms. Once you've been given access to the PEAK Discord, no refund will be issued for any reason.

Your access

Your membership is personal to you. You may not share your login, Discord account, lessons, or access with anyone else, and you may not transfer or resell your membership. You must also follow Discord's own terms of service while using our server. If we find that your access has been shared, we may remove you without a refund.

Community rules and removal

To keep the community useful for everyone, you agree not to:

• harass, threaten, or disrespect other members or mentors;
• spam, advertise, or solicit members for other products, services, signal groups, or trading accounts;
• share false or misleading information about the Program;
• share another member's personal information or results without their permission; or
• break the law while using the Program.

We may warn, suspend, or permanently remove any member who breaks these Terms or our community rules. If you're removed for a violation, you won't receive a refund, and any remaining payment plan or financing balance stays due.

Intellectual property

All lessons, videos, recordings, documents, strategies, and other materials in the Program belong to PEAK or its licensors and are protected by copyright and other laws. We give you a limited, personal, non-transferable license to use them for your own education while you're a member.

You may not record, copy, download (unless we allow it), share, publish, or resell our materials, distribute screenshots or recordings of them, or use them to create your own courses or products. Live calls may be recorded and shared with members as part of the Program.

Your content

You keep ownership of what you post, such as journal entries, trades, and questions. You give PEAK permission to store, review, and display that content inside the Program so we can give you feedback and run the community. We won't publish your name, image, or trading results outside the Program without your permission.

Chargebacks and payment disputes

If you have a problem with a charge, contact us first at abmamllc@gmail.com and give us a chance to resolve it. Disputing a purchase you authorized after you've been given access to the Program is a breach of these Terms.

While a dispute is open, we may suspend your access. We may also submit evidence to your bank or card issuer, including your acceptance of these Terms, records of your access and activity, and our communications with you.

Third-party services

The Program relies on services run by other companies, including Discord, Stripe, Typeform, and financing providers. We don't control those services and aren't responsible for their availability, terms, or actions. Any brokers, platforms, or funded-account firms mentioned in the Program are mentioned for education only, and we don't endorse or guarantee them.

Disclaimer of warranties

The Program is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Program will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, PEAK and its owners, managers, mentors, and team will not be liable for any trading losses, or for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from or related to the Program. Our total liability for any claim related to the Program will not exceed the amount you paid us for the Program in the 12 months before the claim.

Indemnification

You agree to defend and hold harmless PEAK and its owners, managers, mentors, and team from any claims, losses, and expenses, including reasonable attorneys' fees, arising from your trading, your use of the Program, your content, or your violation of these Terms.

Ending your membership

You can stop participating at any time, but stopping doesn't entitle you to a refund or cancel any remaining payments. We may suspend or end your access if you break these Terms. Sections that by their nature should continue after your membership ends, including payments, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply.

Governing law and disputes

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. If a dispute comes up, contact us first and we'll try to resolve it informally. If we can't, you agree that any legal action will be brought only in the state or federal courts located in Wayne County, Michigan, and you consent to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and update the "Last updated" date. Changes apply from the date they're posted.

General

If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a provision, that isn't a waiver of our right to enforce it later. These Terms, together with our Refund Policy, Privacy Policy, Disclaimer, and any written member agreement you sign with us, are the entire agreement between you and PEAK about the Program. If a member agreement you sign conflicts with these Terms, the signed agreement controls. You may not assign these Terms. We may assign them to a successor business.
